LETTER OF COMPLAINT TO MINISTER FOR LOCAL GOVERNMENT

Dear Minister,

COMPLAINTS TO MINISTER REGARDING NOOSA SHIRE COUNCIL

I have made serious allegations regarding the Noosa Shire Council and published them on my website at, http://www.noosarealtor.com . The website can also be found at,

This Council, its Mayor and Councillors have been aware of these developing allegations for some time now since selling a property to my daughter in trade and commerce, as the evidence to support the allegations has become available to me.

Over the past 6 months this Council that you are responsible for, has done very little to constructively address these matters that I complain of and has in fact aggravated the matters by what I perceive to be insults to my intelligence, delays, lying to me in writing, failing to admit its false, misleading & deceptive conduct, compounding that conduct, blaming myself and my daughter for the problems it initiated and now simply laying dormant and refusing to reasonably supply me with information or Council Records that I have requested.

The purpose of this letter is:
to try and avoid legal proceedings being filed by myself and then by my daughter against this Council (and others); and
to try and avoid the resultant tarnishing of the Noosa Region's reputation, that this Council is bringing upon the Noosa Region it administers.

My allegations to date as currently published on my website, are as follows :
1.
Agents Report of Jill Burke and Noosa Property Shop FALSELY REPRESENTING on behalf of the NOOSA SHIRE COUNCIL that this house is 170 square metres in size when it is in fact less than 142 square metres.

ANOTHER FALSE REPRESENTATION of 170 square metres made by a Noosa Property Shop on behalf of the NOOSA SHIRE COUNCIL via an internet publication on www.RealEstate.com.au

We shall see written evidence made by Noosa Council and provided by Noosa Property Shop as to how the renovated bathrooms were represented to be compliant with the Building Code of Australia 2006 (BCA) and compliant with the Noosa Shire Council's own Building Conditions when in fact, in contravention of those requirements, the bathroom floor drains are the highest points in the floors forcing water to flow to the bathroom edges and then leak through the unsealed floors, and then through the timber flooring and over electrical wiring. Video evidence is being prepared of how Noosa Council certifies illegal building work to suit its own purposes.

We shall see written evidence by Noosa Council and provided by Noosa Property Shop that represented that there was wall insulation to the re-lined walls when there was none and how Noosa Council failed to provide wall insulation as required by the BCA and its own Building Conditions and then KNOWINGLY LIED in writing as to BCA compliance after a Noosa Council manager and supervisor inspected the walls.

We shall see evidence of the Noosa Council provision of a MISLEADING & DECEPTIVE statutory Form 21 Final Building Inspection Certificate during the 30 day conveyancing period, which in fact did deceive the purchaser, her family, her agent and lessee.

We shall see written evidence of false representations by Noosa Council and provided by Noosa Property Shop that a concrete slab under the house was 200mm thick and constructed to engineers specifications (which in fact don't exist).
8.
We shall see evidence of how the telephone was represented to be connected to the property when there was in fact no Telstra infrastructure in place which took a month to rectify after the new owner and lessee moved in who were told by Noosa Council to effectively get lost when a complaint was made.
9.
We shall see video evidence of the water delivery pump for the house which was supposedly new, running like a old tractor and the new owner and lessee being told by Noosa Council to effectively get lost when a complaint was made.
10.
We shall see evidence of how the despotic Noosa Council and their idiot lawyer aggravates and continues to aggravate the situation thus providing grounds for a claim of aggravated damages.
11.
We shall see written evidence of how the Noosa Council, its Mayor, Chief Executive Officer and Director of Business, seek to protect the Noosa Council and their own butts by arranging a confidentiality agreement.
12.
We shall see evidence of how the Noosa Council has withheld Council Records contrary to Freedom of Information legislation and Building Records Search for conveyancing purposes, and how it continues to arrogantly disrupt the provision of these Council Records.
13.
We shall see how the Noosa Council refused to apportion the rates charged to the new owner of the property and sought to charge her rates for a period that the Noosa Council owned the property. The new owner's conveyancing lawyer had to be re-engaged to sort out Noosa Council's belligerent conduct.
14.
And there's a whole lot more to come..... but we are hoping that we don't see evidence of a visit from the KKK.
